Olathe HWGA Express Seller Agreement

This Express Tag Agreement is made between seller and Here We Grow Again. It is agreed as follows (check each section):

Seller agrees to allow Here We Grow Again to sell any or all items checked into the Here We Grow Again Sale. I have agreed to allow Here We Grow Again to be responsible for tagging each item and setting the selling price. All express tag items will be marked for discount on our discount days.

Here We Grow Again agrees to pay Seller 35% of the total sales amount of sold items. An additional 5% will be paid to seller if Seller agrees to donate all unsold items for a total of 40% in total sales. A $10 storage fee will be deducted from seller's payout to compensate tagger for storing seller's items until the sale.

ALL ITEMS NOT MEETING SALE CRITERIA WILL BE DONATED. Clothing items should be checked for stains and sorted by size prior to drop off. If more than 25 clothing items are rejected due to stains, dirt, rips, holes, etc., a $15 fee will be deducted from the seller's check to account for the tagger's time and effort to take rejected items to a donation center. The fee will be deducted from the seller's check without prior notification.

Here We Grow Again will send consignor's earnings via e-check within 5 days of consignor pick-up. Checks not cashed within 90 days will be voided. There is a $35 fee to resend a check for any reason.

Seller agrees to consign items that are in working order with batteries, if needed. For each battery we replace, we will deduct $1.00 from seller’s proceeds.

All items not picked up by the end of the designated pick-up period will become property of Here We Grow Again and donated to our local charity.

Seller agrees to hold harmless and make no claim against Here We Grow Again, its agents or representatives, the lessors of the space where the sale is held, any team member or paid participant in the sale, or the insurer of Here We Grow Again for any damage, theft or loss of any items consigned to Here We Grow Again or for personal injury. SELLER EXPRESSLY ASSUMES THE RISK OF THESE EVENTS OCCURRING BY PARTICIPATING IN THE SALE.

Seller recognizes that Here We Grow Again is not responsible for items damaged, lost, or stolen during the sale.

This agreement will remain in force for any future Here We Grow Again Kids Consignment Sale unless cancelled in writing by either party and delivered to the other party.
